Flores v. Kennedy et al.

Peter Flores, a social worker in New York City, received a $25,000 student loan repayment award from the National Health Service Corps (“NHSC”) in 2023. After Peter accepted a promotion within his program, the NHSC unexpectedly determined that he no longer qualified for the award. Peter tried to give the money back, but the NHSC refused to accept it unless he paid nearly $100,000 in penalties and interest.

Flores argues that the fine violates the U.S. Constitution’s Eighth Amendment Excessive Fines Clause and the Seventh Amendment right to trial by jury.

On April 24, 2026, we moved for a preliminary injunction to stop the federal government from sending Peter to collections and imposing interest on his alleged debt while his case is pending. Briefing is complete and we are proceeding with the case while the motion remains pending.
